Transport and planning casework review

From 1 April 2008, the processing of specific planning cases we previously undertook on behalf of the Secretary of State for Communities and Local Government, was moved to new centralised teams.

The planning cases handelled by new central teams are as follows:-

  • Tree Preservation Order (TPO) appeals and Tree Replacement Notice (TRN) appeals
  • Planning/ Housing Compulsory Purchase Orders; Section 19 (Acquisition of Land Act 1981) Open Certificate Applications; and Less Than Best Consideration Land Disposal
  • Other planning casework as listed below:-
    • Listed Building Consent - Local Planning Authority Applications (does not include Listed Building (Private) Applications)
    • Article 4 Directions
    • Completion Notices
    • Modification Orders
    • Revocation Orders
    • Discontinuance Orders
    • Conservation Area Consents
    • Statutory Allotments Disposals
    • 1983 Green Belt Acts
    • Public Requests to Order Disposals (PRODs) of land

Unaffected statutory casework

We will continue to handle planning applications that fall within the following directions:-

  • Departures
  • Shopping Referrals
  • Playing Field Referrals
  • Green Belt Directions
  • Flooding Directions
  • Crown Development
  • Environment Impact Assessment

Other proposed changes - transport casework

A number of statutory Orders/case types for which the Secretary of State for Transport is either the Order making or determining authority will also be centralised, in either the National Transport Casework Team in Newcastle (who currently undertake a national function for Local Authority Orders for Highways proposals) or the Traffic Signs Policy Branch in London.
